BUCKHANNON — Amanda Starr Benson, 38, of Buckhannon was charged with malicious assault and disorderly conduct on March 17. According to the Upshur County Magistrate Court Criminal Complaint, West Virginia State Police officers responded to a domestic incident at 163 Smith Avenue in Buckhannon at 5:08 p.m. on Sunday.
Upon their arrival, the accused advised that she and her husband, Thomas Benson, were engaged in a verbal and physical argument inside of their residence. According to the report, the victim stated that the argument was over the accused leaving to see another man and when she started to become agitated, she began to throw items throughout the home. The victim advised that when he attempted to retreat to the bedroom, she kicked the door in an attempt to get in. The report stated that the victim let her in and he then went into the bathroom in further attempt to get away from her, at which time she kicked that door in as well. During the altercation, the victim said the accused picked up a black kitchen knife and began to slash at and cut him with it, according to the report.
Tpr. John S. Tonkin said he observed four minor lacerations on the victim: one on the right bicep, one on the right lower abdomen, one on the left rib cage area and what appeared to be finger nail scratches on the right side of the neck. After speaking with the accused, the officer was able to locate the knife partially hidden under a hand towel located in the bathroom of the residence.
The criminal complaint stated that once the accused was placed into custody outside of the residence, she began to yell and curse. The officer advised her to stop multiple times, but she continued loud enough for neighbors to be disturbed.
Amanda Benson is currently being held at Tygart Valley Regional Jail in lieu of $75,500 bond.
