Man nets felony arrest for third domestic battery

BUCKHANNON — Law enforcement was called to a domestic altercation in Upshur County Tuesday night.
Donald Diston, 65, of Buckhannon, was arrested for domestic battery third offense following an investigation, according to the criminal complaint in the Upshur County Magistrate Clerk’s office.
On Sept. 12, Cpl. Dewaine Linger with the Upshur County Sheriff’s Department responded to a domestic call on Partridge Road. Upon arrived Linger spoke with the victim who is the wife of Diston. The victim alleged that Diston was was drunk and struck her in the face and broke her glasses.
Linger observed the broken glasses and that the victim’s face was red. Diston allegedly admitted that he broke the glasses. Liston has two previous convictions for domestic battery on Aug. 9, 2010 and April 27, 2017.
Magistrate Kay Hurst set bond at $30,000 cash or surety and ordered Linger to have no contact with the victim.
If convicted, Diston faces confinement in a state correctional facility of not less than one nor more than five years or fined not more than $2,500 or both.
