Man faces child porn charge

CLARKSBURG — A Buckhannon man has been indicted by a federal grand jury on a child pornography charge.

James Andrew Smith, 57, was indicted earlier this month by a federal grand jury sitting in Wheeling for possession of child pornography, one count, according to a press release from the U.S. Attorney’s Office for the Northern District of West Virginia.

Smith, who was previously convicted of possession of child pornography, is accused of having computer disks and other materials containing child pornography in his possession in November 2015.

On or about Nov. 17, 2015, Smith allegedly possessed a computer disk and other material that contained child pornography, according to a copy of the indictment.

Assistant U.S. Attorney David J. Perri is prosecuting the case. During Smith’s initial appearance in federal court Friday morning, U.S. Magistrate Judge Michael Aloi presided.
