Man charged in domestic


BUCKHANNON — A Memorial Day domestic dispute between a couple has led to one man being charged with domestic battery, according to a report filed in Upshur County Magistrate Court.

David Ray Carpenter, 46, Buckhannon, appeared  before Upshur County Magistrate J.M. Coffman on a single count of domestic battery.

According to the report filed by West Virginia State Police Sr. Trooper P.J. Robinette, he responded to a call through Upshur County Communications regarding a call from a passerby who witnessed a woman attempt to run over a man with a car on Vicksburg Road.

Moments later the communication center received a call from Cynthia Cook stating that she had been struck in the face by Carpenter, reportedly her boyfriend. It was noted that Carpenter walked away on foot westbound toward Buckhannon. While on his way to the scene, Upshur County Deputy Sheriff’s Cpl. Theron Caynor made contact with the defendant and detained him as he walked westbound on the southern edge of the road behind a guardrail.

The officer, according to his report, arrived at the scene and made contact with Cook who was seated in the driver’s seat of a maroon 2010 Toyota Yaris. 

According to his report, the officer observed redness and bruising to Cook’s right eye. Cook stated that Carpenter had punched her moments before her calling 911.

Cook stated she and Carpenter had a verbal altercation inside her car at which time she called Carpenter a “cheater.” Cook stated he then called her a “whore”, at which time she raised her right arm swiftly in the direction of Carpenter as if she were going to strike him. Carpenter them struck Cook in the right eye with a closed fist, according to the report.  Cook said Carpenter exited the vehicle at this time and began to walk away.

Robinette asked Cook if she attempted to hit Carpenter with her car at which point she stated he walked into her car. Cook advised she drove toward him yelling for him to get into the car at which point he walked into the passenger side of her vehicle.

Carpenter advised that he had been arguing with Cook at her residence located at Valley Green Apartments. Carpenter stated he walked away in order to cool down at which point Cook followed him. Carpenter stated he was walking down Vicksburg Road northbound at which time Cook drove in his direction lightly striking him on his left side. Carpenter said he sustained no injuries as a result of being struck. Carpenter advised that Cook then exited her vehicle and began trying to slap him. Carpenter stated he raised his arms in the direction of Cook in an attempt to shield himself from being struck. Carpenter denied ever striking Cook but advised the injury to her right eye may have resulted from him shielding himself.
