Cpl. Rocky Hebb with the Upshur County Sheriff’s Department said the victim underwent a forensic interview in which she advised that her mother’s live-in boyfriend allegedly conducted sexual acts on her, according to the criminal complaint in the Upshur County Magistrate Clerk’s office.
Schwable allegedly admitted in an interview with Hebb that he had sex with the juvenile when the mother was not at home and believed it happened in August.
Magistrate Mike Coffman set bond at $100,000 cash only and ordered Schwable to have no contact with the juvenile involved in the case or any juveniles. Schwable has asked for a bond reduction.
If convicted, Schwable faces imprisonment in a correctional facility for not more than 10 nor more than 20 years, or fined not less than $500 nor more than $5,000 and imprisoned in a correctional facility not less than 10 years nor more than 20 years.
