Grand jury indicts 21

BUCKHANNON — Twenty-one people have been indicted by an Upshur County Grand Jury on charges ranging from grand larceny to wanton endangerment to drug-related charges.

Gary William Moran, 37, of Buckhannon, was indicted for daytime burglary, a felony; strangulation, a felony; domestic battery, a misdemeanor; and two counts of driving while license revoked for DUI, second offense, a misdemeanor. Moran allegedly broke into a home at 27 ½ Pinnell Street on Aug. 23, 2017 and strangled the victim.

James R. Wamsley, 20, of Buckhannon, was indicted for sexual assault in the third degree, a felony. On Oct. 17, 2017, Wamsley allegedly had intercourse with a 13-year-old.

William Michael Thomas, 32, of Buckhannon, was indicted for three counts wanton endangerment, a felony.  On Aug. 10, 2017, Thomas allegedly fired a firearm toward a vehicle where three people were sitting.

Vincent G. Baisi, 23, of Charleston, was indicted for two counts of prohibited person in possession of a firearm, a felony; two counts of prohibited person in possession of a concealed firearm, a felony; and driving while license revoked for DUI, second offense, a misdemeanor. On Sept. 30, 2017, Baisi allegedly had a .33 magnum and a .25 caliber handgun despite being prohibited from possessing a firearm due to a felony conviction. Baisi was also allegedly driving when his license had been revoked for DUI in Barbour County on June 23, 2014.

John Thomas Koch, 21, of West Union, was indicted for possession of a controlled substance with intent to deliver methamphetamine, a felony, and obstructing an officer, a misdemeanor. On May 17, 2017, Koch allegedly failed to exit a vehicle upon the instruction of a deputy and also allegedly had meth in his possession.

Dusty A. Turner,27, of Ireland, was indicted for possession of a controlled substance with intent to deliver methamphetamine, a felony. On July 3, 2017, Turner allegedly possessed methamphetamine.

Dustin Lee Watson, 23, of Roanoke, was indicted for fleeing with reckless indifference to the safety of others, a felony, and driving while license revoked for DUI related offenses, second offense, a misdemeanor. On
Oct. 2, 2017, Watson allegedly failed to stop for deputies. His license had been revoked on May 28, 2013 for DUI.

Joseph Patrick Herron, 34, of Buckhannon, was indicted for fleeing with reckless indifference to the safety of others, a felony, and three counts of driving while license revoked for DUI, third offense, a felony. On Aug. 14, 2017, Herron allegedly fled from officers and had prior convictions of driving while revoked for DUI in 2008 and 2009.

Christopher Lee Workman, 30, of Buckhannon, was indicted for possession of a firearm by a prohibited person, a felony; concealment of a firearm by a prohibited person, a felony; and possession of a controlled substance with intent to deliver alprazolam, a felony. On May 28, 2017, Workman allegedly possessed alprazolam and had a firearm concealed under the steering wheel when he was prohibited from possessing a firearm.

Benjamin J. Dickerson Sr., 31, of Buckhannon, was indicted for two counts operating or attempting to operate a clandestine drug lab, a felony. On Oct. 22, 2017, Dickerson allegedly operated a clandestine meth lab.

William J. Smith Jr., 40, of Parkersburg, was indicted for receiving or possessing stolen vehicle, a felony; driving while license revoked for DUI third offense, a felony; and fleeing with reckless indifference to the safety of others, a felony. Smith allegedly had a black Hyundai Sonata which he knew or had reason to believe it was stolen. He then fled from officers. Smith had a prior conviction for driving revoked for DUI on Aug. 22, 2014 in Ritchie County.

Thad Richard Marsh, 25, of Buckhannon, was indicted for possession of a controlled substance with intent to deliver (clonazepam), a felony, and possession of a controlled substance with intent to deliver (hydrocodone), a felony. On Aug. 23, 2017, Marsh allegedly possessed clonazepam and hydrocodone.

Steven John Kacenski, 47, of Warren, Ohio, was indicted for delivery of a controlled substance, (methamphetamine), a felony. On Aug. 16, 2017, Kacenski allegedly possessed meth.

Anthony Michael Demart, 34, of Bethel Park, Pa., was indicted for conspiracy, a felony, and grand larceny, a felony.

Jeffrey P. Gentile, a.k.a. Jeffery P. Gentile, 40, of Pittsburgh, Pa., was indicted for conspiracy, a felony, and grand larceny, a felony. On June 5, 2017, Demart and Gentile allegedly stole electronics from Walmart.

Robert Elliot Brecke, 49, of French Creek, was indicted for possession of a controlled substance with intent to deliver, marijuana, a felony. On Sept. 25, 2017, Brecke allegedly possessed marijuana.

Lindsey Jane Williams, 23, of Buckhannon, was indicted for four counts delivery of a controlled substance, oxycodone, a felony. In August and September, 2016, Williams allegedly delivered oxycodone to another individual.

Christopher Mark Moriarty, 25, of Buckhannon, was indicted for two counts nighttime burglary, a felony; petit larceny, a misdemeanor; three counts destruction of property, a misdemeanor; and assault on an officer, a misdemeanor. On April 13, 2017, Moriarty allegedly broke into a home on Hidden Hills Lane and stole a spud bar and also entered another home on Hidden Hills Lane. Following his arrest, Moriarty allegedly tried to kick Deputy Tyler Chidester and ripped his radar off the rear window of his patrol vehicle.

Sheena Lee Oldaker, 28, of Jane Lew, was indicted for possession of a controlled substance with intent to deliver methamphetamine, a felony. On July 2, 2017, Oldaker allegedly possessed methamphetamine.

Devon Taylor Shaffer, 20, of Marlinton, was indicted for eight counts fraudulent use of an access device, a felony. On July 18, 2017 Shaffer allegedly used a Kroger Rewards Visa Signature credit card belonging to another person to purchase $19 in items from AutoZone and $80.56 from Walmart. On July 19, 2017, Shaffer used the card to purchase $21.69 in items from AutoZone, $27.98 from Sheetz, $29 from Sheetz, $26.11 from Walmart. On July 23, 2017, Shaffer allegedly used the same card to purchase $24 from 7-Eleven and on Aug. 4, 2017, Shaffer used the same card to purchase $236.63 from Walmart.

Joseph Barnett Barnes, 31, of Buckhannon, was indicted for failure to appear, a felony. Barnes failed to appear for his sentencing hearing on Oct. 21, 2016 for a fraud in connection with an access device case.
