Arrest made in UTV theft

BUCKHANNON — A Buckhannon man was taken to Tygart Valley Regional Jail following his arrest for felony grand larceny on May 29.  Brandon Levi Wagoner, 21, reportedly confessed to stealing the 2015 Bennche 700 UTV from Spruce Fork Road on May 24.

According to the Upshur County Magistrate Court Criminal Complaint, the side by side belonged to John McNemar and was left parked under an open-faced storage building owned by Gary Dowell in Buckhannon.  The UTV’s reported value was approximately $12,000.

Court documents said Wagoner’s video confession was obtained by Trooper Tonkin and Cpl. Linger.  Additional information was also given to the McNemar’s by an independent witness. 

If convicted, Wagoner faces confinement in the penitentiary for not less than one, nor more than 10 years, or in the discretion of the court be confined in jail up to one year and fined not more than $2,500.  Wagoner’s bail was set at $50,000 cash or surety.
